Terms of Use
These Terms of Use apply to your access to and use of PathwayPro, including the mobile application, website, educational content, support services, and related features.

1. About these Terms
These Terms of Use apply to your access to and use of:
- the PathwayPro mobile application;
- the PathwayPro website;
- PathwayPro questions, explanations and educational content;
- PathwayPro support services; and
- any related feature or service made available by PathwayPro.
Please read these Terms before using PathwayPro.
By downloading, accessing or using PathwayPro, you agree to these Terms.
If you do not agree to these Terms, you should not use PathwayPro.
2. About PathwayPro
PathwayPro is operated by:
Bailey Ellis, trading as PathwayPro.

In these Terms, “PathwayPro”, “we”, “us” and “our” refer to the operator identified above.
“You” and “your” refer to the person accessing or using PathwayPro.
3. Independent product and RICS disclaimer
PathwayPro is an independent educational and revision product.
PathwayPro is not affiliated with, endorsed by, sponsored by or approved by:
- the Royal Institution of Chartered Surveyors;
- any RICS assessment panel;
- any employer;
- any university; or
- any other professional body, unless expressly stated.
“RICS”, “APC” and the names of competencies, pathways, standards and professional materials may be used descriptively to explain the intended subject matter and audience of the app.
All third-party names, marks and materials remain the property of their respective owners.
4. Educational purpose
PathwayPro provides multiple-choice questions, explanations, revision material and practice features intended to support APC preparation.
PathwayPro is provided for general educational and revision purposes only.
It does not constitute:
- professional advice;
- legal advice;
- surveying advice;
- health and safety advice;
- financial advice;
- regulatory advice;
- career advice;
- an official interpretation of an RICS standard;
- formal APC counselling or supervision; or
- a substitute for professional judgement.
You must not rely on PathwayPro as the sole basis for a professional, contractual, legal, financial, safety-related or regulatory decision.
5. No guarantee of assessment success
Using PathwayPro does not guarantee that you will:
- pass the APC;
- achieve a particular assessment result;
- be considered competent by an assessment panel;
- answer every interview question correctly; or
- meet the requirements of a particular pathway or route.
APC outcomes depend on matters outside our control, including:
- your professional experience;
- the quality and accuracy of your submission;
- your competency evidence;
- your understanding of official requirements;
- your professional judgement;
- your preparation;
- your conduct;
- your performance during assessment; and
- the decisions of the relevant assessment panel.
You remain responsible for your own preparation and submission.
6. Official and current sources
Professional standards, legislation, guidance, pathway requirements and industry practice may change.
You are responsible for checking current authoritative sources, including:
- current RICS pathway guides;
- current RICS professional standards;
- current legislation and regulations;
- official regulatory publications;
- your employer’s procedures;
- guidance from your APC counsellor and supervisor; and
- other sources relevant to your work and pathway.
PathwayPro content should be used as a revision aid alongside, rather than instead of, official sources and practical professional experience.
7. Eligibility
You must be at least 16 years old to use PathwayPro.
If you are under 18, you should ensure that a parent or guardian has reviewed any purchase and these Terms where required by applicable law.
PathwayPro is designed primarily for individuals preparing for professional surveying qualifications.
8. App Store terms
The PathwayPro iOS app is distributed through Apple’s App Store.
Your download and use of the app are also subject to:
- Apple’s applicable App Store terms;
- Apple’s usage rules; and
- Apple’s Standard Licensed Application End User License Agreement.
Apple’s standard EULA applies unless a valid custom EULA is provided through App Store Connect.
Where these Terms conflict with a mandatory Apple term applicable to the App Store transaction or app licence, the applicable Apple term will take priority to the extent of the conflict.
Apple is not responsible for providing PathwayPro customer support. Support for PathwayPro content and functionality is provided by PathwayPro using the details on our Support page.
9. Licence to use PathwayPro
Subject to these Terms and the applicable Apple terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable right to use PathwayPro for your own private educational and revision purposes.
This licence does not transfer ownership of the app or its content to you.
You may install and use the app on Apple devices permitted by Apple’s applicable usage rules.
10. Acceptable use
You may use PathwayPro for your own personal study and revision.
You must not:
- copy substantial parts of the question bank;
- reproduce or republish questions or explanations;
- distribute content to other people;
- upload PathwayPro content to a shared question bank;
- sell, license or commercially exploit PathwayPro content;
- use the content to produce a competing app, course, guide or database;
- scrape, extract or systematically record app content;
- use automated systems, bots or scripts to access the app or website;
- reverse-engineer, decompile or attempt to obtain the source code, except where applicable law does not permit that restriction;
- bypass security or access controls;
- interfere with the proper operation of the app or website;
- introduce malware or harmful code;
- impersonate another person;
- use PathwayPro unlawfully;
- infringe intellectual property or privacy rights; or
- encourage another person to do any of the above.
You may refer to individual questions during private discussions with your counsellor, supervisor or study group, provided this does not involve systematic copying, publication or redistribution of the question bank.
11. Intellectual property
PathwayPro and its original content are protected by intellectual property law.
Unless otherwise stated, PathwayPro owns or licenses the rights in:
- the app;
- the website;
- branding;
- logos;
- design;
- software;
- question structures;
- original question wording;
- original answer options;
- explanations;
- graphics;
- databases;
- arrangements and selection of content; and
- other original materials.
Nothing in these Terms gives you ownership of those rights.
Third-party standards, legislation, guidance, terminology and trademarks remain owned by their respective rights holders.
12. User feedback
You may send suggestions, corrections or other feedback to PathwayPro.
You retain ownership of any original material you submit.
By submitting feedback, you give PathwayPro a worldwide, non-exclusive, royalty-free permission to use, adapt and incorporate that feedback for the purposes of:
- correcting content;
- improving the app;
- developing new features;
- improving support; and
- operating the PathwayPro business.
We will not publicly identify you as the source of feedback without your permission, unless legally required.
Do not submit information that you do not have the right to provide.
13. Content accuracy
We take reasonable steps to produce useful and accurate revision content.
However:
- questions may simplify complex topics;
- more than one approach may be professionally reasonable;
- answers may depend on facts and context;
- official requirements may change;
- legislation and guidance may be updated;
- errors or omissions may occur; and
- content may not cover every issue relevant to your pathway or assessment.
You should report suspected errors to hello@pathwaypro.co.uk.
We may correct, replace or remove content without prior notice.
14. Pricing and payment
The price shown in the App Store at the time of purchase is the price applicable to your transaction, subject to Apple’s terms and any applicable taxes.
The initial version of PathwayPro is intended to be sold as a one-off paid download rather than an automatically renewing subscription.
We may change the price for future purchasers.
A future price change will not result in an additional automatic charge to someone who has already purchased the applicable version, unless they separately choose to purchase a new product or paid feature.
Apple processes App Store payments. PathwayPro does not receive your full payment card details.
15. Refunds and consumer rights
Refund requests for purchases processed through Apple should normally be submitted through Apple’s Report a Problem service.
Apple determines App Store refund eligibility under its terms, procedures and applicable law.
PathwayPro cannot directly access your Apple Account or process a refund through Apple’s systems.
Nothing in these Terms excludes, restricts or replaces any mandatory consumer right available to you.
Digital content supplied to UK consumers must comply with applicable consumer law. Any limitations or exclusions in these Terms apply only to the extent permitted by law.
16. Updates and compatibility
We may release updates to:
- correct errors;
- improve performance;
- add or remove questions;
- update explanations;
- respond to legal or professional developments;
- improve security;
- add features; or
- maintain compatibility with supported devices and operating systems.
You may need to install an update to continue using some functionality.
We do not guarantee that the app will remain compatible with:
- every device;
- every previous version of iOS;
- future operating systems;
- modified or unsupported devices; or
- devices that do not meet minimum technical requirements.
You are responsible for maintaining a compatible device and operating system.
17. Locally stored progress
The current version may store progress, scores, saved questions, weak areas and settings locally on your device.
PathwayPro does not guarantee that locally stored information will always be available or recoverable.
It may be lost if:
- the app is deleted;
- app storage is cleared;
- the device is lost, damaged, reset or replaced;
- an operating system error occurs;
- a backup is unavailable; or
- the app or device becomes corrupted.
PathwayPro does not currently offer its own cloud backup or cross-device progress synchronisation.
You are responsible for maintaining any device backups available to you through Apple.
18. Availability
We aim to make PathwayPro reasonably available, but we do not guarantee uninterrupted or error-free access.
The app or website may be unavailable because of:
- maintenance;
- updates;
- technical faults;
- hosting problems;
- App Store availability;
- device incompatibility;
- security incidents;
- events outside our reasonable control; or
- discontinuation of a feature or service.
Where reasonably practicable, we will take steps to resolve faults that materially affect the app.
19. Third-party services and links
PathwayPro may link to or depend on third-party services, including:
- Apple;
- website hosting providers;
- email service providers;
- external professional resources; and
- official guidance websites.
Third-party services are governed by their own terms and privacy policies.
We are not responsible for the content, availability, security or practices of a third-party website or service that we do not control.
A link does not necessarily mean that PathwayPro endorses the third party.
20. Suspension and termination
We may suspend or terminate access to a PathwayPro website feature or service where we reasonably believe that you have:
- materially breached these Terms;
- used PathwayPro unlawfully;
- infringed intellectual property rights;
- attempted to compromise security;
- interfered with other users;
- scraped or redistributed content; or
- created a material risk to PathwayPro or another person.
Where appropriate and reasonably practicable, we may give you an opportunity to address the issue first.
Termination does not affect rights and obligations that arose before termination.
Provisions concerning intellectual property, liability, governing law and other terms intended to continue will survive termination.
21. Our responsibility to you
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- breach of rights that cannot lawfully be excluded; or
- another matter for which liability cannot legally be limited.
We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for a loss that was not reasonably foreseeable when you began using PathwayPro.
PathwayPro is intended for private educational use. We are not responsible for:
- loss of business;
- loss of profits;
- loss of revenue;
- loss of professional opportunity;
- loss of anticipated savings;
- business interruption; or
- commercial reliance on app content.
We are not responsible for an APC result, assessment decision or professional decision made by you or another person.
Where defective digital content supplied by us damages a device or other digital content belonging to a UK consumer because we failed to use reasonable care and skill, your legal remedies will not be restricted by these Terms.
22. Events outside our control
We will not be responsible for delay or failure caused by an event outside our reasonable control, such as:
- widespread internet or telecommunications failure;
- failure of an App Store service;
- cyberattack;
- natural disaster;
- governmental action;
- industrial dispute; or
- failure of a third-party infrastructure provider.
This does not affect any rights that cannot lawfully be excluded.
23. Privacy
Our collection and use of personal information are explained in the PathwayPro Privacy Policy.
The current version does not require a PathwayPro account and is intended to store individual quiz progress locally.
24. Changes to these Terms
We may update these Terms to reflect:
- changes to PathwayPro;
- legal or regulatory changes;
- new features;
- changes to third-party services;
- security requirements; or
- improvements to the wording.
The current version will be published on this page with an updated date.
Where a change materially affects existing users, we may provide additional notice through the app, website or another reasonable method.
Changes will not retrospectively remove mandatory consumer rights.
25. Transfer of rights
We may transfer our rights and obligations under these Terms to another organisation, for example if the PathwayPro business is sold or reorganised.
Any transfer will not reduce your mandatory rights.
You may not transfer your rights under these Terms to another person except where permitted by Apple’s applicable rules or with our written agreement.
26. Severability
If a court or competent authority finds part of these Terms unlawful or unenforceable, the remaining provisions will continue to apply.
27. No waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived the right to enforce it later.
28. Third-party rights
Except for Apple where it has rights under the applicable Apple Standard EULA, a person who is not a party to these Terms does not have a right to enforce them.
29. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales.
If you are a consumer living in another part of the United Kingdom or another country, you retain the benefit of any mandatory legal protections that apply in the place where you live.
Consumers in England and Wales may bring proceedings in the courts of England and Wales.
Consumers living in Scotland, Northern Ireland or another jurisdiction may also be entitled to bring proceedings in their local courts where applicable law permits.
